Affiliate Terms & Conditions — Kaksamaaya.com

1. Overview

These Affiliate Terms & Conditions (“Agreement”) govern the affiliate program (“Program”) offered by Kaksamaaya.com (“Company”, “we”, “us”, or “our”). By joining the Program, you (“Affiliate”, “you”, or “your”) agree to these terms.

2. Eligibility

2.1 You must be at least 18 years old to participate.
2.2 You must provide accurate legal name, contact information, payment details, and tax details during signup.
2.3 The Company may accept or reject affiliate applications at its sole discretion.

3. Affiliate Relationship

3.1 The relationship between the Affiliate and the Company is that of an independent contractor.
3.2 Nothing in this Agreement creates an employer–employee, partnership, franchise, or agency relationship.

4. Affiliate Links & Tracking

4.1 Upon acceptance, the Affiliate will receive unique tracking links or promotional codes (“Affiliate Links”).
4.2 Only sales or qualified actions (as defined by the Program) completed through valid Affiliate Links are eligible for commission.
4.3 The Company uses tracking systems to record referrals; affiliates are responsible for correct integration of the tracking links.

5. Commission Structure

5.1 Affiliates earn a commission on valid sales or registrations that result from customers clicking the Affiliate Link and completing a purchase or qualifying action.
5.2 Commission rates and eligible products/events will be communicated upon affiliate approval.
5.3 The Company may adjust commission rates at its discretion with notice.

6. Payment Terms & Threshold

6.1 Minimum Payout Threshold: Affiliates become eligible for payment only when their net confirmed commissions reach ₹1,000 INR.
6.2 If a commission balance is below ₹1,000 INR at the end of a payout period, it will roll over to the next cycle.
6.3 Payments are made via bank transfer, UPI, or other payment methods supported by the Company.
6.4 Affiliates are responsible for correct payout details; the Company is not liable for delays due to incorrect information.

7. Reporting & Payment Schedule

7.1 The Company will provide dashboard access or reports reflecting referred sales, commissions, and balances.
7.2 Payments are processed on a monthly basis (or other frequency determined by the Company).
7.3 Pending commissions remain on hold until verification of payment, refunds, returns, or cancellations.

8. Refunds, Returns & Chargebacks

8.1 Commissions on sales that are refunded, canceled, or later charged back will be reversed and deducted from future payouts.
8.2 The Affiliate will not be paid for such transactions.

9. Affiliate Obligations & Restrictions

9.1 Affiliates must promote truthfully and ethically and comply with all applicable laws.
9.2 Affiliates must not:

• Engage in spam or unsolicited communications;

• Use misleading or defamatory claims;

• Bid on Company trademarks in paid advertising without written consent;

• Misrepresent the Company or its services.

10. Intellectual Property

10.1 The Company grants limited rights to use approved marketing materials, logos, and content purely for eligible affiliate promotions.
10.2 All intellectual property rights remain with the Company.

11. Term & Termination

11.1 This Agreement remains in effect until terminated by either party.
11.2 The Company may suspend or terminate an affiliate’s participation at any time for policy violations.
11.3 Upon termination, the Affiliate must immediately stop using all Affiliate Links and Company assets.
11.4 Commissions below the ₹1,000 INR threshold at termination will generally not be paid unless otherwise agreed in writing.

12. Modifications

12.1 The Company may revise these Terms at any time with notice.
12.2 Continued participation after changes constitutes acceptance.

13. Disclaimers & Limitation of Liability

13.1 The Company is not liable for indirect, incidental, special, or consequential damages related to the Program.
13.2 The Company makes no guarantee of earnings or results from participation.

14. Governing Law & Dispute Resolution

14.1 This Agreement is governed by the laws of India.
14.2 Any dispute shall be subject to the exclusive jurisdiction of courts in Delhi/New Delhi, India (or another specified jurisdiction).
